UNDER NO CIRCUMSTANCES SHALL Simply Works Consulting, Inc., BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA OR PROFIT, ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE, EVEN IF Simply Works Consulting, Inc., OR AN AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOUR USE OF MATERIALS FROM THIS SITE RESULTS IN THE NEED FOR SERVICING, REPAIR OR CORRECTION OF EQUIPMENT OR DATA, YOU ASSUME ANY COSTS THEREOF.

2. License - Our WordPress theme licensing is comprised of 3 parts:
(a) PHP Code:
The PHP code and framework is licensed under the GNU general public license.

(b) Javascript
Most of our themes use JavaScript libraries which have their own license. These Javascript libraries do not inherit the GPL license. Most JS libraries use the MIT License.

(c) HTML/Design
The Photoshop design files, HTML code, CSS code, stock photo images, general theme design, and any related files packaged in our themes (non-PHP) are not GPL licensed. They are licensed and copyrighted under TemplateAccess.com/TemplateSOLD. You are strictly prohibited to redistribute or resell these files in any way.

Remember: You may not sell/giveaway our templates to 3rd parties. You may not claim that you designed templates downloaded from our marketplace. You may not include/bundle our templates within your products and sell them. You may not distribute our template after you have performed modifications on it. The images we use are licensed and if you use them without obtaining a proper license you will be liable for damages and copyright infringement.

You can use the templates for your personal website. You can use the templates for your company/corporate website. You can use the templates for your client's websites (3 projects max)

3. Ownership and Liability
You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of Simply Works Consulting, Inc., . Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

4. Refund Policy
We offer refunds to any unsatisfied customer up to 30 days after the purchase was made.

5. Warranty
Our products are provided "as is" without warranty of any kind, either expressed or implied. We do not guarantee that themes will work in all browsers, nor do we guarantee that our themes will be functional with all versions of WordPress. We do not guarantee compatibility with any additional third party plugins, scripts, or applications.

6. Payments
All payments are handled through PayPal using PayPal Business API.

7. Photos Copyright Info
When viewing the theme demos in the gallery SimplyWorksThemes.com you will see several photographic images used. These photos serve as example images only and are not included in the membership, download, software, and/or products. Our themes do not come packaged with any copyrighted photography. The photos used in the demos are purely for demonstration purposes, and are used to give the visitor a functional preview of what the theme will look like once content has been added. You are responsible for adding your own thumbnail images. The photos used in our demos are licensed from www.photoxpress.com, and are Copyright PhotoXpress LLC . These photos should not be saved, copied or redistributed in any way.
